Agreement

By signing up to be an Affiliate in the Master Peace Affiliate Program (“Program”) you are agreeing to be bound by the following terms and conditions (“Terms and conditions”).

Human Consciousness Support, LLC reserves the right to update and change the Terms and conditions from time to time without notice. Any new features that augment or enhance the current Program, including the release of new tools and resources, shall be subject to the Terms and conditions. Continued use of the Program after any such changes shall constitute your consent to such changes.

Violation of any of the terms below will result in the termination of your Account and for forfeiture of any outstanding affiliate commission payments earned during the violation. You agree to use the Affiliate Program at your own risk.

ACCEPTANCE OF TERMS THROUGH USE

By using this site or by clicking “I agree” to this Agreement, you (“User”) signify your agreement to these terms and conditions. If you do not agree to this Agreement, please do not use this site and do not click “I agree”. Please check this Agreement periodically for changes as the owner of this site (“Company”) reserves the right to revise this Agreement. In the event of a change to this Agreement, your continued use of this site following the posting of any changes constitutes acceptance of such changes. The Company reserves the right to terminate a User’s use of this site at any time without notice and may do so for any breach of this Agreement. Most of the credit charges will appear on your statement from Human Consciousness Support, LLC; MasterPeace or similar.

Health and Wellness Disclaimer

MasterPeace by Human Consciousness Support is a natural, nutrient-rich product that nourishes both the body and mind that aims to support users in achieving their goals and improving their lives, including their overall health and wellness. However, we do not make any claims or guarantees regarding specific health or wellness outcomes for any individual user.

Every person’s health and wellness needs and conditions are unique, and results from using our product may vary accordingly. Users should use our product at their own discretion and responsibility, and should not rely solely on it for their health or wellness needs.

We strongly recommend that users consult with their healthcare provider or qualified professionals before using our product, especially if they have any pre-existing medical or psychological conditions or concerns. We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete, or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete, or more timely sources of information. Any reliance on the material on this site is at your own risk.

Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

YOU MUST BE 18 OR OLDER TO AGREE TO THIS AGREEMENT AND USE THIS SITE

This Agreement must be completed, understood and agreed to by a person over 18. If a parent or guardian wishes to permit a person under 18 to access this site, he or she should email the Company with his or her explicit permission and acceptance of full legal responsibility. If you are not yet 18 or are accessing this site from any country where this material is prohibited, please exit now as you do not have proper authorization.

REFUND AND CARRY FORWARD POLICY

All orders on this site and or made to Human Consciousness Support, LLC are final, and cannot be refunded. Due to this refund policy, we do not accept returns.

When using this site or this site’s distribution service you agree that all payment obligations are non-cancelable and all payments made are non-refundable. this site has a strict no-refund policy.

Customers that file credit card disputes untruthfully or incorrectly may have their right of service revoked at our discretion.

As a general matter, prepayments for distribution services do not have a time limit and MasterPeace by Human Consciousness Support product undertaking to provide such distribution services does not expire as of a certain date. However, the company shall not be obligated to provide such distribution service if any of the following three factors shall be in effect:

• This site is no longer in the business of distributing press releases;
• Suitable distribution channels are not available; or
• The cost of distribution has risen to such an extent that this site cannot economically provide such service given the amount prepaid.

MISCELLANEOUS

You warrant and represent to Us that you have all necessary rights, power, and authority to agree to these Terms and perform your obligations hereunder, and nothing contained in this Agreement or in the performance of such obligations will place you in breach of any other contract or obligation. The failure of either party to exercise in any respect any right provided for herein will not be deemed a waiver of any further rights hereunder. If any provision of this Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect and enforceable. Any new features, changes, updates, or improvements of the Program shall be subject to this Agreement unless explicitly stated otherwise in writing. We reserve the right to change this Agreement from time to time. Any updates to this Agreement shall be communicated to you. You acknowledge your responsibility to review this Agreement from time to time and to be aware of any such changes. By continuing to participate in the Program after any such changes, you accept this Agreement, as modified.

LICENSE TO USE THIS SITE

Upon your agreement, Company hereby grants you a non-exclusive, non-transferable limited license to use this site in strict accordance with the terms and conditions in this Agreement. You agree not to make any false or fraudulent statements as you use this site. You acknowledge and agree that all content and services available on this site are property of the Company and are protected by copyrights, trademarks, service marks, patents, trade secrets, and other proprietary rights and laws, in the U.S. and internationally. All rights not expressly granted herein are fully reserved by the Company, its advertisers, and licensors. You agree to pay for any and all purchases and services using your name and credit card through this Site, not to challenge any such charges and to pay for all collections and/or attorney’s fees resulting from any nonpayment.

LICENSE RESTRICTIONS

Use: Except as may be explicitly permitted, you agree not to save, download, cut and paste, sell, license, rent, lease, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from materials from this site. Systematic retrieval of data or other content from this site to create or compile, directly or indirectly, a collection, database, or directory without written permission from Human Consciousness Support, LLC is prohibited. In addition, use of the content or materials for any purpose not expressly permitted in this Agreement is prohibited.

REFERRAL GUIDELINES

If you refer MasterPeace by Human Consciousness Support, LLC to others, you agree to follow MasterPeace Terms and Conditions, User Content Guidelines, Rules of Conduct, and Notices of Restrictions. You may not make any false claims about MasterPeace by Human Consciousness Support, LLC, and you must disclose any material connection you have with MasterPeace when referring the product to others.

Furthermore, you must respect the intellectual property rights of MasterPeace and may not use any of our trademarks, copyrights, or patents without our express written permission.

MasterPeace reserves the right to terminate your referral privileges if you violate any of our policies or engage in any behavior that we deem inappropriate or harmful.

SECURITY

You agree that if you are issued a Username and Password by the Human Consciousness Support, LLC, you shall use your best efforts to prevent access to this site through your Username and Password by anyone other than yourself, including but not limited to, keeping such information strictly confidential, notifying the Company immediately if you discover loss or access to such information by an unauthorized party and by using a secure Username and Password not easily guessed by a third party. You agree that you shall not try to reverse assemble, reverse compile, decompile, disassemble, translate, or otherwise alter any executable code, contents or materials on or received via this site. You understand that such actions are likely to subject you to serious civil and criminal legal penalties and that the Company shall pursue such penalties to the full extent of the law to protect its rights and the rights of its other licensors.

USER’S LICENSE GRANT TO SITE

Except with regard to personal information, all information which you post on this site or communicate to the Company through this site (collectively “Submissions”) shall forever be the property of the Company. Human Consciousness Support, LLC shall not treat any submission as confidential and shall not incur any liability as a result of any similarities that may appear in future Company services or products. RESELLER CLAUSE

MasterPeace by Human Consciousness Support, LLC is a product sold exclusively through authorized MasterPeace distributors. It is important to note that MasterPeace does not offer a reseller’s license and therefore, is not able to authorize any individual or entity to resell our products.

By purchasing MasterPeace by Human Consciousness Support, LLC, you acknowledge and understand that it is intended for personal use only and NOT FOR RESALE. You further agree that any attempt to resell the product may result in MasterPeace terminating your account and pursuing legal action against you.

MasterPeace by Human Consciousness Support, LLC, its assigns, affiliates, associates, and all related parties shall not be liable for any damages, claims, or losses arising from any unauthorized reselling of the product.

LIMITATION OF LIABILITY

HOLD HARMLESS

User agrees to indemnify and hold harmless Human Consciousness Support, LLC, its officers, assigns, directors, agents, employees, and affiliates from and against any and all claims, damages, expenses, and liabilities, including attorneys’ fees, arising out of or in connection with Human Consciousness Support, LLC.

AGREEMENT TO NOT SUE IN COURT

User agrees that any dispute or controversy arising out of or in connection with this Agreement or its interpretation, including any disputes regarding arbitrability, shall be resolved through binding arbitration instead of in court. The Parties agree to waive any right to a jury trial and agree that the arbitration award shall be final and binding. The arbitration shall be conducted in accordance with the rules of the [arbitration association], and the arbitration shall be held in [city, state].

LEGAL COMPLIANCE

Human Consciousness Support, LLC may suspend or terminate this Agreement or User’s use immediately upon receipt of any notice which alleges that User has used this site for any purpose that violates any local, state, federal or law of other nations, including but not limited to the posting of information that may violate third party rights, that may defame a third party, that may be obscene or pornographic, that may harass or assault other, that may violate hacking or other criminal regulations of its agent, officers, directors, contractors or employees. In such an event, the Company may disclose the User’s identity and a subpoena or other legal action, and Company shall not be liable for damages or results thereof and User agrees not to bring any action or claim against Company for such disclosure.

CHOICE OF LAW AND FORUM

This site (excluding third party linked sites) is controlled by the Company from its offices within the State of Kansas, U.S. of America. It can be accessed from all 50 states as well as from other countries around the world to the extent permitted by site. As each of these places has laws that may differ from Kansas, by assessing this site, both you and the Company agree that the statutes and laws of Kansas shall apply to any actions or claims arising out of or in relation to this Agreement or your use of this site, without regards to conflicts of laws principles thereof. You and the Company also agree and hereby submit to the filing of any claim only in the exclusive personal jurisdiction and venue of Kansas and any legal proceedings shall be conducted in English. The Company makes no representation that materials on this site are appropriate or available for use in other locations and accessing them from territories where their contents are illegal is prohibited.

Dispute Resolution; Arbitration; Venue; Severability

DISPUTE RESOLUTION; ARBITRATION; VENUE; SEVERABILITY

IMPORTANT NOTE: PLEASE READ THIS SECTION CAREFULLY BECAUSE IT REQUIRES YOU AND US TO RESOLVE ALL DISPUTES BETWEEN US THROUGH BINDING INDIVIDUAL MEDIATION OR ARBITRATION AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF FROM MASTERPEACE, ITS ASSIGNS OR AFFILLIATES. YOU UNDERSTAND AND AGREE THAT, BY ENTERING INTO THESE TERMS OF USE, YOU AND WE ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION.

BINDING ARBITRATION.

Except as described in the “Exceptions” section below, you and We agree that every dispute arising out of or relating to your use of these Terms of Use, the Services, or communications from Us or from any third-party service provider acting on Our behalf (whether or not related to the transmittal of mobile messages within the scope of the Program), will be resolved through binding arbitration. Arbitration uses a neutral arbitrator instead of a judge or jury, is less formal than a court proceeding, may allow for more limited discovery than in court, and is subject to very limited review by courts. This agreement to arbitrate disputes includes all claims whether based in contract, tort, statute, regulation, ordinance, fraud, misrepresentation, common law, constitutional provision, respondent superior, agency or any other legal or equitable theory, regardless of whether a claim arises after the termination of these Terms of Use, and regardless of whether a claim arises before or after the effective date of these Terms of Use. Any dispute relating to the interpretation, applicability, or enforceability of this binding arbitration agreement will be resolved by the arbitrator.

EXEPTIONS

Although we are agreeing to arbitrate most disputes between you and Us, nothing in these Terms of Use will be deemed to waive, preclude, or otherwise limit the right of either party to: (a) bring an individual action in small claims court; (b) file suit in a court of law to address an intellectual property infringement claim; or (c) seek injunctive relief in a court of law in a state or federal court in LaCynge, Kansas, County of Linn.

ARBITRATOR

This arbitration agreement, and any arbitration between us, is subject to the Federal Arbitration Act and will be administered by the American Arbitration Association (“AAA“) under its Consumer Arbitration Rules (collectively, “AAA Rules“) as modified by these Terms of Use. The AAA Rules and filing forms are available online at www.adr.org, by calling the AAA at +1-800-778-7879, or by contacting Us.

COMMENCING ARBITRATION

Before initiating arbitration, a party must first send a written notice of the dispute to the other party by Certified U.S. Mail ATTN: “Notice of Arbitration“. Our address for Notice is:

The Notice of Arbitration must: (a) identify the name or account number of the party making the claim; (b) describe the nature and basis of the claim or dispute; and (c) set forth the specific relief sought (“Demand“). The parties will make good faith efforts to resolve the claim directly, but if the parties do not reach an agreement to do so within 30 days after the Notice of Arbitration is received, you or We may commence an arbitration proceeding. If the arbitrator finds that either the substance of the claim or the relief sought in the Demand is frivolous or brought for an improper purpose (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)), then the payment of all fees will be governed by the AAA Rules and We may seek reimbursement for any fees paid to AAA.

ARBITRATION PROCEEDINGS

Any arbitration hearing will take place in the county and state of Human Consciousness Support, LLC. If the claim is for US$10,000 or less (and does not seek injunctive relief) an in-person hearing as established by the AAA Rules in the county (or parish) of your billing address. During the arbitration, the amount of any settlement offer made by you or Us must not be disclosed to the arbitrator until after the arbitrator makes a final decision and award, if any. Regardless of the manner in which the arbitration is conducted, the arbitrator must issue a reasoned written decision sufficient to explain the essential findings and conclusions on which the decision and award, if any, are based.

ARBTRATION RELIEF

Except as provided in the “No Class Actions” section below, the arbitrator can award any relief that would be available if the claims had been brought in a court of competent jurisdiction. The arbitrator’s award shall be final and binding on all parties. Judgment on the award may be entered in any court having jurisdiction.

NO CLASS ACTIONS

YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and We agree otherwise in writing, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.

LIMITED TIME TO FILE CLAIMS
